General Terms and Conditions

1. Scope of Application


These General Terms and Conditions (GTC) apply to all business relationships arising through the website https://setupinaustria.at  between PSTax Steuerberatung GmbH and Mag.a Miglena Hofer, LL.M. (hereinafter jointly referred to as “the Providers”) and their clients.

The version valid at the time of the conclusion of the contract applies.


Further details are governed by the respective individual agreements and by the Providers’ own GTC, which remain fully applicable:

2. Subject of the Agreement


The Providers jointly offer advisory services for individuals establishing operations in Austria, combining tax advisory and business consulting.

The exact scope of services includes the following:

2.1. BUSINESS REGISTRATION 

up to two free business licenses registration (if applicable to your profession);

SVS social security registration (pension, health, accident insurance) and co-insurance of your dependents;

"Neue Selbständige" registration if no business license needed;

Contract review (we check client contracts for compliance with the regulations for bogus self-employment);

"Doing Business in Austria as a Foreigner" guide (digital resource covering everything for a strong foundation).

2.2. TAX SETUP & ONGOING SUPPORT (Pascal)

Tax office registration (Finanzamt)

VAT ID registration (if your revenue requires it);

Email support for tax questions throughout your first year (no extra charges for basic questions);

Your first income tax return (Einkommensteuererklärung);

VAT return (if applicable);

Collaborative bookkeeping template (track everything correctly from day one);

Year-end tax optimization (ensure you're not overpaying);

SVS optimization support (manage prepayments, avoid overpaying social security);

SVS consulting via email (questions about contributions, thresholds, etc.);

Invoice template (legally compliant for Austria);

Tax payment reminders (so you never miss a deadline).



A different variation of this package is possible upon the Providers’ explicit agreement. 


3. Conclusion of Contract


A contract is concluded upon:


payment via the website, or written, electronic, or verbal confirmation of an offer by either Provider.


4. Fees and Payment Terms


Payments are made in advance unless otherwise agreed. 

The billing is carried by PSTax FlexCo.

Accepted payment methods include credit card, bank transfer, Apple Pay, Google Pay, or instant transfer.

For consulting services rendered separately by either Provider, their individual payment and billing terms apply as defined in their respective GTC.


5. Performance and Deliverables


The Providers, including members of their staff, fulfill their assignments with due care, diligence, and professional expertise under Austrian professional standards.

For tax advisory services, the General Terms and Conditions of the Austrian Chamber of Tax Advisors and Auditors (AAB of KSW) apply in their current version.

For business consulting services, the Consultant’s detailed terms and service descriptions apply as set out in her individual GTC.


6. Data Protection


Personal data are processed in accordance with the joint Privacy Policy and the respective individual privacy statements of both Providers.


7. Liability


Each Provider is responsible for their own area of work and professional obligations.

Liability is excluded for slight negligence, except for personal injury.

Any further liability follows the provisions of the respective Provider’s GTC.

If the client provides incomplete, incorrect, or misleading information, and as a result suffers damages, financial loss, or missed profit, or if the service cannot be properly fulfilled for that reason, the provider shall bear no liability for such consequences.

Any additional costs or delays arising from inaccurate or incomplete information shall be borne by the client.


8. Intellectual Property


All content, materials, and documents provided as part of the joint service remain the intellectual property of the respective authoring Provider.

Any duplication or distribution requires prior written consent.


9. Governing Law and Jurisdiction


These Terms are governed by Austrian substantive law, excluding its conflict-of-law rules.

The place of jurisdiction shall be the competent court at the business location of the Provider primarily responsible for the specific service.


10. Severability Clause


If any provision of these terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.

The invalid clause shall be replaced by one that most closely reflects the intended purpose.

Client’s Obligation to Provide Information / Declaration of Completeness

 The Client shall at all times duly make available to the Providers all information and documents that the Providers deems necessary to be able to carry out the assignment correctly, in the specific form and manner. Also, the Client shall provide all cooperation required for the proper and timely performance of the Engagement.

The Client shall duly inform the Providers of any facts and circumstances or changes in facts and circumstances that may be relevant in connection with the execution of the assignment.

If the Client doesn’t meet these obligations, the Consultant shall be held harmless against all the loss, expenses, or damages arising by the Client’s negligence.


Cancellation and Withdrawal Policy 

1. Scope
This policy applies to contracts concluded between the Providers, and Clients who are consumers within the meaning of §1 FAGG (i.e., private individuals acting outside their business or professional activity).

For business clients (B2B), the right of withdrawal under FAGG does not apply.

2. Right of Withdrawal (Widerrufsrecht)

If the contract is concluded online, by email, or off-premises, the client has the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period begins:

on the day the contract is concluded (see point 3), or

when the client receives written information about their withdrawal rights, whichever is later.

To exercise this right, the client must send a clear statement (e.g., by email) to:
[email protected] or to [email protected]  stating that they wish to withdraw from the contract.


3. Effects of Withdrawal

If the client withdraws within the withdrawal period, all payments received will be refunded without undue delay and no later than 14 days from the day we receive the withdrawal notice.
Refunds will be made using the same payment method originally used unless otherwise agreed.
No fees will be charged for the refund.

4. Commencement of Services Before the End of the Withdrawal Period

If the client requests that the service begins before the 14-day withdrawal period expires, they must acknowledge that:

the right of withdrawal is lost once the service has been fully performed, and

if the service is only partially performed by the time of withdrawal, the client must pay a proportionate amount for the service already rendered.

Example: If your desired starting business day is October 1st, and have filed the necessary paperwork before that, you will be charged for the submission of documents in an aliquot part of the price of the service.


5. Exceptions to the Right of Withdrawal (§18 FAGG)

The right of withdrawal does not apply to:

Services that have already been fully performed, if the service began with the consumer’s prior consent and acknowledgment that the right of withdrawal would be lost upon full performance;

Digital content not supplied on a physical medium (e.g. downloadable material) once delivery has begun with the client’s consent;

Customised or personalised services explicitly tailored to the client.
